1. User’s Relationship with Us

Welcome to Tfarraj!

Tfarraj is a social media platform (the “Platform”) provided by Tharaa Information Technology Company (“Tharaa”). Tharaa and its affiliated companies, Platform, and websites are collectively referred to in this Agreement as We, Us, and Our. (“We”, “Us”, “Our”).

We offer a growing selection of Services, for the avoidance of doubt, Our Services include related websites, applications, and products (collectively, the “Services”).

This Terms of Service (the “Terms”) Agreement establishes the framework that defines the relationship between Us and every User, regardless of being an individual, legal entity, system, or device, collectively all Users (the “User”), that interacts with Our Services, and sets forth the terms and conditions by which the User may access and use Our Services.

Once accepted, Our Terms form a legally binding agreement between the User and Us. Please take the time to read these Terms carefully.

2. Accepting Our Terms

By accessing or using Our Services, User unconditionally accepts Our Terms of Service. In addition, User acknowledges and understands that User has entered into and formed and binding contract with Us, that User accepts the Terms of Service in their entirety and that User agrees to comply with them. User’s access to the Services and use of Our Services is also subject to our Privacy Policy and Community Guidelines, the terms of which can be located directly on Our Platform, Applications, and websites and are available download, and are incorporated herein by reference. By using Our Services, User without and limitations or restrictions consent to the Terms of Service and the Privacy Policy.

If User accesses or uses the Services from within a jurisdiction for which there are separate supplemental terms, User also hereby agree to any Supplemental Terms applicable to users in each jurisdiction and in the event of a conflict between the provisions of the Jurisdiction-Specific terms that are relevant to User’s jurisdiction from which User access or use the Services, and the rest of these Terms, the relevant jurisdictions’ Jurisdiction-Specific Terms will supersede and the Terms within this Agreement if there is a conflict. If User does not agree to these Terms for any reason, User must not access or use any of Our Services.

If User accesses or uses the Services on behalf of a business or entity, then (a) User includes the individual or system accessing Our Services and the business or entity, (b) User represents and warrants that User is an authorized representative of the business or entity with the authority to bind the entity to these Terms, and that User agrees to these Terms on the entity’s behalf, and (c) User’s business or entity is legally and financially responsible for User’s access or use of the Services as well as for the access or use of User’s account by others affiliated with User’s entity, including any employees, agents or contractors.

User accepts these Terms by accessing or using our Services. User understands and agrees that We will treat User’s access or use of the Services as acceptance of these Terms as of the time of accessing and onwards.

3. Changes to the Terms

Terms of Service are subject to change at our discretion. Users are advised to review the current Terms of Service prior to using our Services. All Users are subject to the most current version, Last Updated, of the Terms of Service while using our Services. If an updated Terms of Service is published and a User, new or existing, uses Our Services they are entering into a new binding agreement to adhere to the Terms of Service published at that time. Each time a User accepts a revised Terms of Service agreement they are also accepting the new Terms of Service will retroactively apply to pervious sessions where Our Services were accessed or visited by the User.

Users should print off or save a local copy of the most current Terms for User’s records.

We amend these Terms from time to time, for instance when we update the functionality of Our Services, when we combine multiple apps or services operated by us or our affiliates into a single combined service or app, or when there are regulatory changes. We will use commercially reasonable efforts to generally notify all users of any material changes to these Terms, such as through a notice on our Platform, however, User should look at the Terms regularly to check for such changes. We will also update the User’s continued access or use of the Services after the date of the new Terms constitutes User’s acceptance of the new Terms. If User do not agree to the new Terms, User must stop accessing or using the Services. “Last Updated” date at the top of these Terms, which reflect the effective date of such Terms.

4. User’s Account with Us

To access or use some of Our Services, User must create an account with us. When User create this account, User must provide accurate and up-to-date information. It is important that User maintain and promptly update User’s details and any other information User provide to us, to keep such information current and complete.

It is important that User keep User’s account password confidential, and that User does not disclose account credentials to any third party. If User know or suspect that any third party knows User’s password or has accessed User’s account, User must notify us immediately at: https://tfarraj.tv/.

User agree that User are solely responsible (to us and to others) for the activity that occurs under User’s account.

We reserve the right to disable User’s user account at any time, including if User have failed to comply with any of the provisions of these Terms, or if activities occur on User’s account which, in Our sole discretion, would or might cause damage to or impair the Services or infringe or violate any third-party rights, or violate any applicable laws or regulations.

If User no longer want to use Our Services again, and would like User’s account deleted, simply select delete account in User profile page and User’s account will be permanently deleted and all User’s account data will be deleted. Once User choose to delete User’s account, User will not be able to reactivate User’s account or retrieve any of the content or information User have added.

5. User’s Access to and Use of Our Services

User’s access to and use of the Services is subject to these Terms and all applicable laws and regulations. User may not:

In addition to the above, User’s access to and use of the Services must, at all times, be compliant with Our Community Guidelines.

We reserve the right, at any time and without prior notice, to remove or disable access to content at Our discretion for any reason or no reason. Some of the reasons we may remove or disable access to content may include finding the content objectionable, in violation of these Terms or Our Community Guidelines, or otherwise harmful to the Services or Our users. Our automated systems analyze User’s content to provide User personally relevant product features, such as customized search results, tailored advertising, and spam and malware detection. This analysis occurs as the content is sent, received, and when it is stored.

6. Intellectual Property Rights

We respect intellectual property rights and ask User to do the same. As a condition of User’s access to and use of the Services, User agree not to use the Services to infringe on any intellectual property rights. We reserve the right, with or without notice, at any time and in Our sole discretion to block access to and/or terminate the accounts of any user who infringes or is alleged to infringe any copyrights or other intellectual property rights.

7. Content

A. Tfarraj Content

As between User and Us, all content, software, images, text, graphics, illustrations, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music on and “look and feel” of the Services, and all intellectual property rights related thereto (the “Tfarraj Content”), are either owned or licensed by Us, it being understood that User or User’s licensors will own any User Content (as defined below) User upload or transmit through the Services. Use of the Tfarraj Content or materials on the Services for any purpose not expressly permitted by these Terms is strictly prohibited. Such content may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed or otherwise exploited for any purpose whatsoever without Our or, where applicable, Our licensors’ prior written consent. We and Our licensors reserve all rights not expressly granted in and to their content.

User acknowledge and agree that we may generate revenues, increase goodwill or otherwise increase Our value from User’s use of the Services, including, by way of example and not limitation, through the sale of advertising, sponsorships, promotions, usage data and Gifts, and except as specifically permitted by us in these Terms or in another agreement User enter into with us, User will have no right to share in any such revenue, goodwill or value whatsoever. User further acknowledge that, except as specifically permitted by us in these Terms or in another agreement User enter into with us, User (i) have no right to receive any income or other consideration from any User Content (defined below) or User’s use of any musical works, sound recordings or audiovisual clips made available to User on or through the Services, including in any User Content created by User, and (ii) are prohibited from exercising any rights to monetize or obtain consideration from any User Content within the Services or on any third party service (e.g., User cannot claim User Content that has been uploaded to a social media platform such as YouTube for monetization).

Subject to the terms and conditions of the Terms, User are hereby granted a non-exclusive, limited, non-transferable, non-sublicensable, revocable, worldwide license to access and use the Services, including to download the Platform on a permitted device, and to access Our Content solely for User’s personal, non-commercial use through User’s use of the Services and solely in compliance with these Terms. We reserve all rights not expressly granted herein in the Services and Our Content. User acknowledge and agree that We may terminate this license at any time for any reason or no reason.

NO RIGHTS ARE LICENSED WITH RESPECT TO SOUND RECORDINGS AND THE MUSICAL WORKS EMBODIED THEREIN THAT ARE MADE AVAILABLE FROM OR THROUGH THE SERVICE.

User acknowledge and agree that when User view content provided by others on the Services, User are doing so at User’s own risk. The content on Our Services is provided for general information only. It is not intended to amount to advice on which User should rely. User must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on Our Services.

We make no representations, warranties or guarantees, whether express or implied, that any of Our Content (including User Content) is accurate, complete or up to date. Where Our Services contain links to other sites and resources provided by third parties, these links are provided for User’s information only. We have no control over the contents of those sites or resources. Such links should not be interpreted as approval by us of those linked websites or information User may obtain from them. User acknowledge that we have no obligation to pre-screen, monitor, review, or edit any content posted by User and other users on the Services (including User Content).

B. User-Generated Content

Users of the Services may be permitted to upload, post or transmit (such as via a stream) or otherwise make available content through the Services including, without limitation, any text, photographs, user videos, sound recordings and the musical works embodied therein, including videos that incorporate locally stored sound recordings from User’s personal music library and ambient noise (“User Content”). Users of the Services may also extract all or any portion of User Content created by another user to produce additional User Content, including collaborative User Content with other users, that combine and intersperse User Content generated by more than one user. Users of the Services may also overlay music, graphics, stickers, virtual items and other elements provided through a Service offered by Us. All content is provided by User, We do not have any requirement to verify or approve content submitted or transmitted on any of our Services by any User. The views expressed by User on any of Our Services do not represent Our views or values.

Whenever User access or use a feature that allows User to upload or transmit User Content through the Services (including via certain third-party social media platforms such as Instagram, Facebook, YouTube, Twitter), or to make contact with other users of the Services, User must comply with the standards set out in Our Terms of Service. User may also choose to upload or transmit User’s User Content, including User Content that includes Tfarraj Elements, on sites or platforms hosted by third parties. If User decide to do this, User must comply with their content guidelines as well as with the standards set out in Our Terms of Service.

User warrant that any such contribution does comply with those standards, and User will be liable to us and indemnify us for any breach of that warranty. This means User will be responsible for any loss or damage we suffer as a result of User’s breach of warranty.

Any User Content will be considered non-confidential and non-proprietary. User must not post any User Content on or through the Services or transmit to us any User Content that User consider to be confidential or proprietary. When User submit User Content through the Services, User agree and represent that User own that User Content, or User have received all necessary permissions, clearances from, or are authorized by, the owner of any part of the content to submit it to the Services, to transmit it from the Services to other third-party platforms, and/or adopt any third party content.

If User only own the rights in and to a sound recording, but not to the underlying musical works embodied in such sound recordings, then User must not post such sound recordings to the Services unless User have all permissions, clearances from, or are authorized by, the owner of any part of the content to submit it to the Services.

User or the owner of User’s User Content still own the copyright in User Content sent to us, but by submitting User Content via the Services, User hereby grant us an unconditional irrevocable, non-exclusive, royalty-free, fully transferable, perpetual worldwide license to use, modify, adapt, reproduce, make derivative works of, publish and/or transmit, and/or distribute and to authorize other users of the Services and other third-parties to view, access, use, download, modify, adapt, reproduce, make derivative works of, publish and/or transmit User’s User Content in any format and on any platform, either now known or hereinafter invented.

User further grant us a royalty-free license to use User’s username, image, voice, and likeness to identify User as the source of any of User’s User Content.

For the avoidance of doubt, the rights granted in the preceding paragraphs of this Section include, but are not limited to, the right to reproduce sound recordings (and make mechanical reproductions of the musical works embodied in such sound recordings), and publicly perform and communicate to the public sound recordings (and the musical works embodied therein), all on a royalty-free basis. This means that User are granting us the right to use User’s User Content without the obligation to pay royalties to any third party, including, but not limited to, a sound recording copyright owner (e.g., a record label), a musical work copyright owner (e.g., a music publisher), a performing rights organization (e.g., ASCAP, BMI, SESAC, etc.) (a “PRO”), a sound recording PRO (e.g., SoundExchange), any unions or guilds, and engineers, producers or other royalty participants involved in the creation of User Content.

Specific Rules for Musical Works and for Recording Artists. If User is a composer or author of a musical work and are affiliated with a PRO, then User must notify User’s PRO of the royalty-free license User grant through these Terms in User’s User Content to us. User are solely responsible for ensuring User’s compliance with the relevant PRO’s reporting obligations. If User have assigned User’s rights to a music publisher, then User must obtain the consent of such music publisher to grant the royalty-free license(s) set forth in these Terms in User’s User Content or have such music publisher enter into these Terms with us. Just because User authored a musical work (e.g., wrote a song) does not mean User have the right to grant us the licenses in these Terms. If User are a recording artist under contract with a record label, then User are solely responsible for ensuring that User’s use of the Services is in compliance with any contractual obligations User may have to User’s record label, including if User create any new recordings through the Services that may be claimed by User’s label.

Through-To-The-Audience Rights. All of the rights User grant in User’s User Content in these Terms are provided on a through-to-the-audience basis, meaning the owners or operators of third party services will not have any separate liability to User or any other third party for User Content posted or used on such third party service via the Services.

Artificial Intelligence User is required to disclose in the title of their content submitted to Our Services if an Artificial Intelligence application or service had been used to generate, create, or modify content in whole or part. For the purpose of clarification Artificial Intelligence is defined as any software capability designed to generate original content or modify existing content.

Waiver of Rights to User Content. By posting User Content to or through the Services, User waives any rights to prior inspection or approval of any marketing or promotional materials related to such User Content. User also waive any and all rights of privacy, publicity, or any other rights of a similar nature in connection with User’s User Content, or any portion thereof. To the extent any moral rights are not transferable or assignable, User hereby waive and agree never to assert any and all moral rights, or to support, maintain or permit any action based on any moral rights that User may have in or with respect to any User Content User Post to or through the Services.

We also have the right to disclose User’s identity to any third party who is claiming that any User Content posted or uploaded by User to Our Services constitutes a violation of their intellectual property rights, or of their right to privacy.

We, or authorized third parties, reserve the right to cut, crop, edit or refuse to publish, User’s content at Our or authorized third parties sole discretion. We have the right to remove, disallow, block or delete any posting User make on Our Services if, in Our opinion, User’s post does not comply with the content standards set out at “User’s Access to and Use of Our Services” above. In addition, we have the right – but not the obligation – in Our sole discretion to remove, disallow, block or delete any User Content (i) that we consider to violate these Terms, or (ii) in response to complaints from other users or third parties, with or without notice and without any liability to User. As a result, we recommend that User save copies of any User Content that User post to the Services on User’s personal device(s) in the event that User want to ensure that User have permanent access to copies of such User Content. We do not guarantee the accuracy, integrity, appropriateness or quality of any User Content, and under no circumstances will we be liable in any way for any User Content.

User control whether User’s User Content is made publicly available on the Services to all other users of the Services or only available to people User approve. To restrict access to User’s User Content, User should select the privacy setting available within the Platform.

We accept no liability in respect of any content submitted by users and published by us or by authorized third parties.

If User finds inappropriate content that violates Our Community Guidelines or have any other issues User would like to raise, User can send us a report.

We take reasonable measures to expeditiously remove from Our Services any infringing material that we become aware of. It is Our policy, in appropriate circumstances and at its discretion, to disable or terminate the accounts of users of the Services who repeatedly infringe copyrights or intellectual property rights of others.

While Our own staff is continually working to develop and evaluate Our own product ideas and features, we pride ourselves on paying close attention to the interests, feedback, comments, and suggestions we receive from the user community. If User choose to contribute by sending us or Our employees any ideas for products, services, features, modifications, enhancements, content, refinements, technologies, content offerings (such as audio, visual, games, or other types of content), promotions, strategies, or product/feature names, or any related documentation, artwork, computer code, diagrams, or other materials (collectively “Feedback”), then regardless of what User’s accompanying communication may say, the following terms will apply, so that future misunderstandings can be avoided. Accordingly, by sending Feedback to us, User agree that:

  1. We have no obligation to review, consider, or implement User’s Feedback, or to return to User all or part of any Feedback for any reason;

  2. Feedback is provided on a non-confidential basis, and we are not under any obligation to keep any Feedback User send confidential or to refrain from using or disclosing it in any way; and

  3. User irrevocably grant us perpetual and unlimited permission to reproduce, distribute, create derivative works of, modify, publicly perform (including on a through-to-the-audience basis), communicate to the public, make available, publicly display, and otherwise use and exploit the Feedback and derivatives thereof for any purpose and without restriction, free of charge and without attribution of any kind, including by making, using, selling, offering for sale, importing, and promoting commercial products and services that incorporate or embody Feedback, whether in whole or in part, and whether as provided or as modified.

8. Indemnity

User agree to defend, indemnify, and hold harmless Tfarraj, Tharaa, and each of their directors, employees, agents, advisors, investors, subsidiaries, affiliates, and where applicable, each of their respective officers, directors, employees, agents and advisors from any and all claims, liabilities, costs, and expenses, including, but not limited to, attorneys’ fees and expenses, arising out of a breach by User or any user of User’s account of these Terms or arising out of a breach of User’s obligations, representation and warranties under these Terms.

9. EXCLUSION OF WARRANTIES

NOTHING IN THESE TERMS SHALL AFFECT ANY STATUTORY RIGHTS THAT USER CANNOT CONTRACTUALLY AGREE TO ALTER OR WAIVE AND ARE LEGALLY ALWAYS ENTITLED TO AS A CONSUMER.

THE SERVICES ARE PROVIDED “AS IS” AND WE MAKE NO WARRANTY OR REPRESENTATION TO USER WITH RESPECT TO THEM. IN PARTICULAR WE DO NOT REPRESENT OR WARRANT TO USER THAT:

NO CONDITIONS, WARRANTIES OR OTHER TERMS (INCLUDING ANY IMPLIED TERMS AS TO SATISFACTORY QUALITY, FITNESS FOR PURPOSE OR CONFORMANCE WITH DESCRIPTION) APPLY TO THE SERVICES EXCEPT TO THE EXTENT THAT THEY ARE EXPRESSLY SET OUT IN THE TERMS. WE MAY CHANGE, SUSPEND, WITHDRAW OR RESTRICT THE AVAILABILITY OF ALL OR ANY PART OF OUR PLATFORM FOR BUSINESS AND OPERATIONAL REASONS AT ANY TIME WITHOUT NOTICE.

10. LIMITATION OF LIABILITY

NOTHING IN THESE TERMS SHALL EXCLUDE OR LIMIT OUR LIABILITY FOR LOSSES WHICH MAY NOT BE LAWFULLY EXCLUDED OR LIMITED BY APPLICABLE LAW. THIS INCLUDES LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE OR THE NEGLIGENCE OF OUR EMPLOYEES, AGENTS OR SUBCONTRACTORS AND FOR FRAUD OR FRAUDULENT MISREPRESENTATION.

SUBJECT TO THE PARAGRAPH ABOVE, WE SHALL NOT BE LIABLE TO USER FOR:

(I) ANY LOSS OF PROFIT (WHETHER INCURRED DIRECTLY OR INDIRECTLY); (II) ANY LOSS OF GOODWILL; (III) ANY LOSS OF OPPORTUNITY; (IV) ANY LOSS OF DATA SUFFERED BY USER; OR (V) ANY INDIRECT OR CONSEQUENTIAL LOSSES WHICH MAY BE INCURRED BY USER. ANY OTHER LOSS WILL BE LIMITED TO THE AMOUNT PAID BY USER TO US WITHIN THE LAST 12 MONTHS.

ANY LOSS OR DAMAGE WHICH MAY BE INCURRED BY USER AS A RESULT OF:

PLEASE NOTE THAT WE ONLY PROVIDE OUR PLATFORM FOR DOMESTIC AND PRIVATE USE. USER AGREE NOT TO USE OUR PLATFORM FOR ANY COMMERCIAL OR BUSINESS PURPOSES, AND WE HAVE NO LIABILITY TO USER FOR ANY LOSS OF PROFIT, LOSS OF BUSINESS, LOSS OF GOODWILL OR BUSINESS REPUTATION, BUSINESS INTERRUPTION, OR LOSS OF BUSINESS OPPORTUNITY.

IF DEFECTIVE DIGITAL CONTENT THAT WE HAVE SUPPLIED DAMAGES A DEVICE OR DIGITAL CONTENT BELONGING TO USER AND THIS IS CAUSED BY OUR FAILURE TO USE REASONABLE CARE AND SKILL, WE WILL EITHER REPAIR THE DAMAGE OR PAY USER COMPENSATION. HOWEVER, WE WILL NOT BE LIABLE FOR DAMAGE THAT USER COULD HAVE AVOIDED BY FOLLOWING OUR ADVICE TO APPLY AN UPDATE OFFERED TO USER FREE OF CHARGE OR FOR DAMAGE THAT WAS CAUSED BY USER FAILING TO CORRECTLY FOLLOW INSTALLATION INSTRUCTIONS OR TO HAVE IN PLACE THE MINIMUM SYSTEM REQUIREMENTS ADVISED BY US.

THESE LIMITATIONS ON OUR LIABILITY TO USER SHALL APPLY WHETHER OR NOT WE HAVE BEEN ADVISED OF OR SHOULD HAVE BEEN AWARE OF THE POSSIBILITY OF ANY SUCH LOSSES ARISING.

USER ARE RESPONSIBLE FOR ANY MOBILE CHARGES THAT MAY APPLY TO USER’S USE OF OUR SERVICE, INCLUDING TEXT-MESSAGING AND DATA CHARGES. IF USER’RE UNSURE WHAT THOSE CHARGES MAY BE, USER SHOULD ASK USER’S SERVICE PROVIDER BEFORE USING THE SERVICE.

TO THE FULLEST EXTENT PERMITTED BY LAW, ANY DISPUTE USER HAVE WITH ANY THIRD PARTY ARISING OUT OF USER’S USE OF THE SERVICES, INCLUDING, BY WAY OF EXAMPLE AND NOT LIMITATION, ANY CARRIER, COPYRIGHT OWNER OR OTHER USER, IS DIRECTLY BETWEEN USER AND SUCH THIRD PARTY, AND USER IRREVOCABLY RELEASE US AND OUR AFFILIATES FROM ANY AND ALL CLAIMS, DEMANDS AND DAMAGES (ACTUAL AND CONSEQUENTIAL) OF EVERY KIND AND NATURE, KNOWN AND UNKNOWN, ARISING OUT OF OR IN ANY WAY CONNECTED WITH SUCH DISPUTES.

11. Other Terms

a. Applicable Law and Jurisdiction. Subject to the Supplemental Terms – Jurisdiction Specific, these Terms, their subject matter and their formation, are governed by the laws of the United States. Any dispute arising out of or in connection with these Terms, including any question regarding existence, validity or termination of these Terms, shall be referred to and finally resolved by arbitration and it is hereby agreed that the dispute shall be referred to United States Arbitration & Mediation for arbitration in accordance with United States Arbitration & Mediation Rules of Arbitration. The arbitrator’s decision shall be final and binding and judgment may be entered thereon. In the event a party fails to proceed with arbitration, unsuccessfully challenges the arbitrator’s award, or fails to comply with arbitrator’s award, the other party is entitled of costs of suit including a reasonable attorney’s fee for having to compel arbitration or defend or enforce the award.

b. Open Source. The Platform contains certain open source software. Each item of open source software is subject to its own applicable license terms, which can be found at Open Source Policy.

c. Entire Agreement. These Terms (including the Supplemental Terms below) constitute the whole legal agreement between User and US and govern User’s use of the Services and completely replace any prior agreements between User and US in relation to the Services.

d. Links. User may link to our home page, provided User does so in a way that is fair and legal and does not damage our reputation or take advantage of it. User must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. User must not establish a link to our Services in any website that is not owned by any User. The website in which the User are linking must comply in all respects with the content standards set out at “User Access to and Use of Our Services” above. We reserve the right to withdraw linking permission without notice.

e. Age Limit. The Services are only for people 13 years old and over (with additional limits that may be set forth in the Jurisdiction-Specific Terms. By using the Services, User confirms that User is over the relevant age specified herein. If we learn that someone under the relevant age specified above is using the Services, we will terminate that user’s account.

f. No Waiver. Our failure to insist upon or enforce any provision of these Terms shall not be construed as a waiver of any provision or right.

g. Security. We do not guarantee that our Services will be secure or free from bugs or viruses. User is responsible for configuring User information technology, computer programs and platform to access our Services. User should use their own virus protection software.

h. Severability. If any court of law, having jurisdiction to decide on this matter, rules that any provision of these Terms is invalid, then that provision will be removed from the Terms without affecting the rest of the Terms, and the remaining provisions of the Terms will continue to be valid and enforceable.

Supplemental Terms – App Stores

To the extent permitted by applicable law, the following supplemental terms shall apply when accessing the Platform through specific devices:

This Privacy Policy applies to Tfarraj (the “Platform”) and Platform services, which includes apps, websites, software and related services accessed via any User or device that link to this Privacy Policy. Business Partners

If User chooses to register to use the Platform using User’s social network account details (e.g., Facebook, Twitter, Instagram, Google), User will provide us or allow User’s social network to provide us with User’s phone number, email address, username and public profile. We will likewise share certain information with the relevant social network such as User’s app ID, access token and the referring URL. If User chooses to allow a third-party service to access User’s account, we will share certain information about User with the third party. Depending on the permissions User grants, the third party may be able to obtain User’s account information and other information User choose to provide.

Where User opts to share content on social media platforms, the video, username and accompanying text will be shared on that platform or, in the case of sharing via instant messaging platforms such as WhatsApp, a link to the content will be shared.

We provide information and content to service providers who support our business, such as cloud service providers and providers of content moderation services to ensure that the Platform is a safe and enjoyable place and service providers that assist us in marketing the Platform.

Advertisers, Advertising Networks and Measurement Partners

We share information with advertisers and third-party measurement companies to show how many and which users of the Platform have viewed or clicked on an advertisement.

If User uses the Platform’s Lite version of Tfarraj, we share information with advertising networks to display personalized advertisements to User on the Tfarraj Lite app and elsewhere online. We are not responsible for the privacy practices of these third parties, and the information practices of these third parties are not covered by this Privacy Policy.

Independent Researchers

We share User’s information with independent researchers to facilitate research that meets certain criteria.

Our Corporate Group

We may also share User’s information with other members, subsidiaries, or affiliates of our corporate group, including to provide the Platform, to improve and optimize the Platform, to prevent illegal use and to support users.

Public Profiles

Please note that if User’s profile is public, User content will be visible to anyone on the Platform and may also be accessed or shared by User’s friends and followers as well as third parties such as search engines, content aggregators and news sites. User can change who can see a video each time User uploads a video. Alternatively, User can change User’s profile to default private by changing User settings to 'Private Account' in “Manage my account” settings.

Sale, Merger or Other Business Transactions

We may also disclose User information to third parties:

When User makes a purchase through our shopping features, we share the information related to the transaction with the merchant, payment and transaction fulfillment providers, and other service providers. Where We Store User Information

User information may be stored on servers located outside the country where User lives, such as in Saudi Arabia, Germany or the United States. We maintain major servers around the world to bring User our services globally and continuously.

User has rights and choices when it comes to User’s information. User may be afforded certain rights under applicable laws, which may include the right to access, delete, update, or rectify User’s data, to be informed of the processing of User’s data, to file complaints with authorities, and potentially other rights. User may appeal any decision we have made about User’s request by following the instructions in the communication User receives from us notifying User of our decision. User can access and edit most of User’s profile information by signing into the Platform. User can delete the User Content User uploaded. We also provide a number of tools in Settings that allow User to control, among others, who can view User’s videos, send User messages, or post comments to User’s videos. Should User choose to do so, User may delete User’s entire account in Settings.

User may be able to refuse or disable Cookies by adjusting User’s device browser settings. Because each browser is different, please consult the instructions provided by User’s browser. Please note that User may need to take additional steps to refuse or disable certain types of Cookies. For example, due to differences in how browsers and mobile apps function, User may need to take different steps to opt out of Cookies used for targeted advertising in a browser and to opt out of targeted advertising for a mobile application, which User may control through User’s device settings or mobile app permissions. In addition, User’s opt-out selection is specific to the particular browser or device that User are using when User opt out, so User may need to opt-out separately for each of browser or device. If User choose to refuse, disable, or delete Cookies, some of the functionality of the Platform may no longer be available to User.

The Security of User’s Information

We take steps to ensure that User’s information is treated securely and in accordance with this policy. Unfortunately, the transmission of information via the internet is not completely secure. Although we will use reasonable measures to protect User’s personal data, for example, by encryption, we cannot guarantee the security of User’s information transmitted via the Platform; any transmission is at User’s own risk.

We have appropriate technical and organizational measures to ensure a level of security appropriate to the risk of varying likelihood and severity for the rights and freedoms of User and other users. We maintain these technical and organizational measures and will amend them from time to time to improve the overall security of our systems.

We will, from time to time, include links to and from the websites of our partner networks, advertisers and affiliates. If User follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these policies. Please check these policies before User submit any information to these websites.

How Long We Keep User’s Information

We retain information for as long as necessary to provide the Platform and for the other purposes set out in this Privacy Policy. We also retain information when necessary to comply with contractual and legal obligations, when we have a legitimate business interest to do so (such as improving and developing the Platform, and enhancing its safety, security and stability), and for the exercise or defense of legal claims.

The retention periods are different depending on different criteria, such as the type of information and the purposes for which we use the information. For example, when we process User’s information such as User’s profile information to provide User with the Platform, we keep this information for as long as User have an account. If User violate our Terms of Service, Community Guidelines, or other conditions or policies, we may remove User’s profile and User Content from public view immediately, but may keep other information about User to process the violation.

Platform is not directed at children under the age of 13. Privacy Policy Update

We may update this Privacy Policy from time to time. When we update the Privacy Policy, we will notify User by updating the “Last Updated” date at the top of this policy and posting the new Privacy Policy or providing any other notice required by applicable law. User’s continued access to or use of the Platform after the date of the updated policy constitutes User’s acceptance of the updated policy. Our mission is to inspire creativity and bring joy. We aspire to unlock human imagination by enabling creative expression and being a source of entertainment and enrichment everywhere. We welcome people from around the world, as they come to the Platform to discover a diversity of ideas, creators, and products, and to connect with others in our community. To help ensure a safe, trustworthy, and vibrant experience, we maintain a set of Community Guidelines that include rules and standards for using Tfarraj, the Platform. The guidelines apply to everyone and everything on our Platform. They are informed by international legal frameworks, industry best practices, and input from our community, safety and public health experts, and our regional Advisory Councils. We evolve them to address emerging risks and potential harms that may occur from new behaviors. Our approach to content moderation is built on four pillars:

  1. Remove violative content from the platform that breaks our rules

  2. Restrict mature content through physical moderation so it remains private in user accounts

  3. Maintain User’s feed standards to help ensure any content that may be promoted by our recommendation system is appropriate for a broad audience

  4. Empower our community with information, tools, and resources

Our guidelines are organized by topic area, with each rule in bold. Under each section User can click for more information where User can find definitions, specific examples, and clarifications to common questions about what is allowed. Please be aware that the examples do not cover everything (we note this upfront so User don’t have to repeatedly read the phrase “including, but not limited to”). Keeping our community both safe and vibrant requires finding the right balance between enabling expression and preventing harm. We do this through a mix of safety approaches, from developing rules and standards that we enforce, to building platform norms and resources that give our community members more agency and choice.

  1. Remove violative content. Everyone joins the Platform with the ability to freely share content on our Platform. However, we have rules regarding harmful content that we do not allow. Through direct moderation, we seek to remove any content, whether publicly posted or private, that violates our rules. Although we work hard to enforce our rules, we cannot guarantee that all content shared on our Services complies with our Terms of Service or Community Guidelines. If someone has severe or repeated violations, we will also ban the account.

  2. Age-restrict mature content. The breadth of content that is shared on the Platform is vast, which adds to the rich diversity of the experience. However, not all of it may be suitable for young audiences. Through direct moderation, we limit overtly mature content so it does not get introduced into User’s feed by our recommendation system.

  3. Maintain User’s feed eligibility standards. The feed offers an opportunity for viewers to discover new content and for creators to reach new audiences. But promotion by our recommendation system is not guaranteed. Content that is not appropriate for a broad audience will be ineligible for the feed.

  4. Empower our community. We want to make sure User have the right information to help User manage User’s experience on our Platform. For certain content, we add labels, warnings to provide more context or notice. User can Block user that create content that User are not comfortable seeing.
